Who should invest in an EB-5 program?

EB-5 investors vary greatly, whether they are interested business professionals looking to make a sound investment and obtain permanent residence or an individual interested in furthering their child’s education via access to a Green Card. Even though an EB-5 permits employment in the U.S., retired business professionals can take part in the investment partnership and earn a Green Card while not needing to actively maintain the business. Due to the fact that EB-5 investment Green Cards apply beyond the single investor, a spouse and children under 21 can also receive Green Cards.

In order to process my visa application, what documents do I need to prepare?

Each applicant must prepare and supply complete biographical information. The principal investor must also provide and prove the source of funds for the investment. You must also be prepared to supply financial records (tax returns, bank statements), a requirement of the U.S. Citizenship and Immigration Services (USCIS). How long does it take for an EB-5 Visa Green Card application to be approved?

Although the total time varies, on average the entire process from application submission to approval can take nine to fifteen months. Two of those months are allotted for making the investment, gathering the necessary documents and filing Form I-526 (Immigrant Petition by Alien Entrepreneur) with the particular regional U.S. Citizenship and Immigration Services (USCIS) Service Center. At that point, petition approval can on average last 6 months and will require the investor to prove that the assets were gained in a lawful manner. The applicant and their respective family must then take part in an interview at the US embassy in their country, and undergo medical, police, security and immigration history checks before having conditional permanent resident visas issued. A conditional Green Card, once issued, allows the investor and their immediate family to emigrate within 180 days of visa issuance from the consulate.

How important is the location of the EB-5 Regional Center?

Even though your investment will grant you access to a Green Card and the ability to live anywhere throughout the United States, it is still crucial to consider the location of the EB-5 Regional Center. The location can affect the amount of your required minimum qualifying investment of either $1 million or $500,000 (associated with Targeted Employment Areas) and visa requirements.

The location of the regional center and the project itself can vary, and you must realize that minimum investment is not always based on the location of the center, but rather where the specific project funds are invested. One cannot also assume that a particular regional center will continuing investing in the same project location over time, and must verify the potential new locations and minimum investment for each project. In addition, visa approval investment can also vary between projects.

No matter how great the project and investment may appear on paper, it is essential to explore the location to ensure that the specific region will in fact support this particular project. The surrounding economic climate, work force, and property markets will have a great effect on the project’s success or failure.

The location of the project will also impact your exit strategy. We recommend that you physically visit the region to observe the area and go beyond the paper research that may fail to truly represent all of the crucial details associated with the location. A detailed review will ensure a secure investment, exit strategy and profit. Although if you are unable to travel, we recommend that you seek the counsel of an impartial advisor. That being said, we strongly believe that it is essential for each investor to investigate the location of both the center and projects to ensure success of investments and securing visas.

What should I know about the EB-5 Visa Program before making a decision?

Although regional centers will provide you with countless reasons why you should invest in their particular project, it is imperative to have an impartial advisor who is familiar with your particular, personal goals talk with a Regional Center representative. In doing so, the advisor can carefully consider if your personal requirements and needs are a match with the particular project, all while considering potential risks associated with the project. A well-informed, realistic perspective is crucial in the decision making process.

What should I consider when making my EB-5 investment choice?
